HR 3200 Section 1233

As readers of my blog you have known for quite a while I am a believer in smaller more efficient government. For the next several weeks I will be posting specific sections of House Bill 3200. The sections will be my objections to the passage of this bill and any bill that attempts to add another Government Entitlement to an all ready bankrupt budget. This current Congress is totally and completely irresponsible regarding what Americans want.

I give you House Bill 3200

Advance Care Planning Consultation

    `(hhh)(1) Subject to paragraphs (3) and (4), the term `advance care planning consultation' means a consultation between the individual and a practitioner described in paragraph (2) regarding advance care planning, if, subject to paragraph (3), the individual involved has not had such a consultation within the last 5 years. Such consultation shall include the following:
      `(A) An explanation by the practitioner of advance care planning, including key questions and considerations, important steps, and suggested people to talk to.
      `(B) An explanation by the practitioner of advance directives, including living wills and durable powers of attorney, and their uses.
      `(C) An explanation by the practitioner of the role and responsibilities of a health care proxy.
      `(D) The provision by the practitioner of a list of national and State-specific resources to assist consumers and their families with advance care planning, including the national toll-free hotline, the advance care planning clearinghouses, and State legal service organizations (including those funded through the Older Americans Act of 1965).
      `(E) An explanation by the practitioner of the continuum of end-of-life services and supports available, including palliative care and hospice, and benefits for such services and supports that are available under this title.
      `(F)(i) Subject to clause (ii), an explanation of orders regarding life sustaining treatment or similar orders, which shall include--
        `(I) the reasons why the development of such an order is beneficial to the individual and the individual's family and the reasons why such an order should be updated periodically as the health of the individual changes;
        `(II) the information needed for an individual or legal surrogate to make informed decisions regarding the completion of such an order; and
        `(III) the identification of resources that an individual may use to determine the requirements of the State in which such individual resides so that the treatment wishes of that individual will be carried out if the individual is unable to communicate those wishes, including requirements regarding the designation of a surrogate decisionmaker (also known as a health care proxy).
      `(ii) The Secretary shall limit the requirement for explanations under clause (i) to consultations furnished in a State--
        `(I) in which all legal barriers have been addressed for enabling orders for life sustaining treatment to constitute a set of medical orders respected across all care settings; and
        `(II) that has in effect a program for orders for life sustaining treatment described in clause (iii).
      `(iii) A program for orders for life sustaining treatment for a States described in this clause is a program that--
        `(I) ensures such orders are standardized and uniquely identifiable throughout the State;
        `(II) distributes or makes accessible such orders to physicians and other health professionals that (acting within the scope of the professional's authority under State law) may sign orders for life sustaining treatment;
        `(III) provides training for health care professionals across the continuum of care about the goals and use of orders for life sustaining treatment; and
        `(IV) is guided by a coalition of stakeholders includes representatives from emergency medical services, emergency department physicians or nurses, state long-term care association, state medical association, state surveyors, agency responsible for senior services, state department of health, state hospital association, home health association, state bar association, and state hospice association.

Fishy! Hell, this is a bureaucratic nightmare! My wife and I made our decision and no %@&&%$%#!@ government moron would have changed that. Nor does any government moron have the right to interject their bureaucratic opinion into ANY American families life ending decision! PERIOD

If all of this goes through, I am afraid what will be next. Maybe they will start with our food and give us allowance so we can all eat the same. Why should I and my family eat steak while the others eat ramen noodles? I can just hear it now. Thanks for posting this!

You can see that Germany and France, countries with "socialized medicine," have more doctors per capita than the US.

Wonderful, you got the point. You are now on your way to being a Conservative. The bills are so confusing even an attorney can't read them. And, that's what a congressman recently said "on the record"

Did you clik on the link showing we were also 3rd in funding for people who have no insurance?

Let's be fair and balanced.

But why do we have people who have no insurance? I guess Germany and France would be last in funding for people who have no insurance, since they have no people with no insurance.

Do you really consider government sanctioned medical practices, health insurance? Insurance in its truest form is/was developed for catastrophic losses, NOT, minor problems.

How many of American citizens have the opportunity to purchase insurance but choose not to. It is a matter or choice, not all the time a matter of price.

Medicaid was developed to take care of indigent Americans who have NO other means of medical coverage.

One final point, Cost. Are you aware that Medicare is to be cut by 500 Million dollars to help pay for people who a. have no insurance, b. have it available but, won't buy it, c. just don't give a hoot and like living on the government doles because they are too lazy to work!

1. Which Congressman said the bill is so confusing that an attorney cannot read it? I'm assuming a Conservative...

2. Most Rev, I agree; no one is going to suggest that I need to attend an end of life seminar. Um, where did you find that?

3. Pops, I hope you understand that when you say "bureaucrat" you are implying ALL people in politics. Since let's face it, they spew it out and we follow it like lambs. Such as the governor who said that Obama wasn't a natural born citizen to cause the stir and then came back a little while later saying that he is and "we need to focus on real issues."

I now await the moment when the Conservative Republicans come out and say that the health care bill is just fine while the Americans who follow every word are still being lobbied to go to Town Halls across the country.

@Pops- the issue of cutting Medicare was thwarted today on CNN as well as during the townhall. Also, it was determined that people will not be forced to change their current health care plans; the new plan just gives healthy competition to the already existing plans.

I am sure that you can find this info on www.cnn.com/campbellbrown

As for the next comment regarding people unable to attend today's townhall, it was required that people who wanted to come in had to sign a sheet and give a phone number. I don't see the big deal if these people are who they say they are; unless they had something to hide.

For the comment regarding crowd control- this is the President and the biggest target in the world. Safety and security I'm sure is the priority as the mobs were getting violent. I guess they will also need some health care as well. :)

@JP- Sure good to see another lib on the line.
